‘Knicks Maccabi Tel Aviv Video Contest’
Article 1. Organiser
The Consulate General of Israel is an integral part of the State of Israel’s Ministry of Foreign Affairs which is located in Jerusalem, Israel, which hereafter will be referred to as “CGI”. CGI is organizing a video contest named “Knicks Maccabi Tel Aviv Video Contest” from September 20th, 2007 through September 30th, 2007.
This contest gives the opportunity to win the prizes described in Article 5 hereunder.
Article 2. Participants
This contest is open to any individual over 13 years old excluding:
• Members of staff (and members of their families) of CGI and the Foreign Ministry of Israel.
• Any other company or individual having participated in the conception of the Knicks Maccabi Tel Aviv Video Contest;
• And of any company or individual having participated, directly or indirectly, in the elaboration of the contest;
Article 3. Conditions for Participation
To participate in the contest :
• log onto the website www.isrealli.org/maccabi to learn about the contest and its modalities of participation;
• Prepare a video in accordance with the following rules :
• Duration: must be exactly 30 seconds;
• Themes: ‘Sites & Faces of Israel’
• Upload before September 30th, 2007 including, the video with the complete details of the participant, by Internet on the website www.youtube.com and comment with the video link to isrealli.org/maccabi
Any entry form that is wrongly completed, incomplete, altered or received after the closing date of the game shall not be considered for a prize under Article 5.
CGI shall not be liable for any loss or damage with respect to any participant or product produced by any participant.
• The videos sent before September 30th, 2007 included and in accordance with the rules here above, shall be available on the Internet on www.youtube.com and www.isrealli.org/maccabi
Article 4. Selection Procedure and Methods
Phase 1
Contestants shall be judged in a broad sense on the basis of the following criteria:
• Originality
• Creativity;
• Quality of the video;
• Aesthetic quality;
• Sound Quality;
• Individual/Group Initiative;
• Positive Messaging;
• Positive Images;
• Conformity with the theme selected;
A committee of CGI staff, shall meet on September 30th, 2007 and evaluate and determine the best of the submissions.
The videos selected by the CGI committee will then have a chance to be played at the Knicks Maccabi Tel Aviv exhibition basketball game on October 11th, 2007 at Madison Square Garden for the ticket buying audience. Most ticket buyers will be a given a score card to rate the selected videos and select their favourite video screened during the exhibition game. The video which receives the most audience votes as indicated on the score cards shall be awarded the prize as outlined in Article 5.
Article 5. Awarding of Prizes
The video submission winner shall receive:
• A round trip flight ticket from Israel to New York or from New York to Israel from the America Israel Friendship League, herewith referred to as “AIFL”.
The winner will be solely responsible for any and all local, city, state, and federal taxes and fees associated with the cash prize. The winner shall bear the cost of transportation from his/her home to the departure airport as well as the return from the arrival airport to their home. It is expressly stipulated that any travel insurance, personal expenditure, as well as any problem relating to insurance coverage, particularly for legal liability, repatriation and/or assistance will remain at the sole charge and full discretion of the winner
The winner shall be informed of the results by message through the website www.isrealli.org platform within 10 days from the closing date of the audience score card tally. The winner shall then reply to CGI within 7 days to the following email address info@isrealli.org and give its complete details (name, address, email address and phone number).
The purchase voucher or the flight tickets shall be sent to the winners within 4 weeks from his reply to the address provided on his email reply.
Article 6
Only one prize may be collected per household (same family name, same address).
Article 7
Participation in this draw implies acceptance in full of the terms and conditions herein.
Any breach of any of the provisions in these terms and conditions will result in disqualification of the person having committed such breach. Any dispute as to the interpretation thereof will be decided by the organisers.
Any claims must be addressed in writing by recorded delivery with acknowledgement of receipt before September 30th, 2007, to Mr. David Saranga, CGI, 800 2nd Avenue NY New York 10010. Such claims may relate only to the substance of the conditions in which the game is held.
Article 8
Prizes may not be exchanged for their cash value or replaced for any reason whatsoever. They may not be taken in any other form than that provided by these terms and conditions. In the case of force majeure, if circumstances so require, the organisers reserve the right to replace the winning prize with a substitute of equal value or of similar specifications.
Article 9
The organisers reserve the right to modify, defer, curtail or cancel this game without having to provide grounds, without notice and without liability on their part arising there from.
Article 10
Moreover, CGI shall not be liable in the event that access to the websites and/or viewing of the websites should prove to be difficult or impossible for the participants. No claim shall be accepted on these grounds.
CGI shall not be liable should the data relating to a participant’s registration fail to reach it for any reason for which it is not liable (e.g., a problem with the Internet connection for any reason whatsoever at the participant’s home, momentary failure of our servers for any reason, etc.) or reach it in an illegible or non-processable form (e.g., if the participant has computer hardware or a software environment that is inadequate for his/her registration, etc.).
Article 11
Unless otherwise stipulated by the participants, the organisers will retain participants’ personal details as obtained from the game and may utilize such information.
Article 12
The winning videos shall become the sole property of CGI. Participants agree in advance without restriction or reservation to allow the organizers, for an unlimited period of time and throughout the whole world, a free use of their video and their name for advertising or public relations purposes without such use conferring upon them any remuneration rights or benefits whatsoever.
The participants represent and warrant to CGI that the videos filmed and created by them do not infringe upon a trademark or any other right owned by third parties in particular their image right. The participants shall indemnify and keep indemnified CGI against any and all claims from of, loss, costs, damages and liability in case the video would be alleged to infringe upon a trademark or any other right owned by third parties.
Article 13
The participants expressly recognize that these Terms and Conditions do not invest them with any property right on the trademarks, designs and models, logos and graphic designs or any other work that may be intellectual or industrial property of which CGI or any one of the Foreign Ministry of Israel may be the owner.
Article 14
A copy will be sent free of charge on written request to Mr. David Saranga, CGI, 800 2nd Avenue NY New York 10010. Postage will be reimbursed on request (at current second class mail rates).
Article 17
THE PRESENT TERMS AND CONDITIONS SHALL BE SUBJECT TO THE LAW OF THE UNITED STATES OF AMERICA AND SHALL BE INTERPRETED UNDER THAT SAME LAW.
ANY DISPUTE OR PROTEST TO WHICH THE PRESENT TERMS AND CONDITIONS MAY GIVE RISE IN RESPECT OF BOTH VALIDITY AND INTERPRETATION, PERFORMANCE OR EXECUTION SHALL BE SUBJECT TO ARBITRATION ONLY AND THE PARTICIPANT MAY CHOOSE ONE ARBITRATOR, CGI MAY CHOOSE A SECOND ARBITRATOR AND THE TWO OF THEM SHALL CHOOSE A THIRD ARBITRATOR. THE DECISION OF THE ARBITRATOR SHALL BE FINAL AND UNDER NO CIRCUMSTANCE SHALL BE SUBJECT TO ANY JUDICIAL PROCEEDINGS..
